1. In general

The following terms and conditions apply to all contracts, deliveries and other services concluded via the online store of "SUMSUM the brand". No other provisions shall apply; all ancillary agreements require our written confirmation.


2. Order

Your order represents a non-binding offer to conclude a purchase contract with us. After you have placed your order on sumsumthebrand.com, you will receive an e-mail confirming the receipt of your order - a so-called "order confirmation". With this e-mail we do not accept your offer: The purchase contract is not concluded until we send you a shipping confirmation in the form of a second e-mail. Missing items in your shipping confirmation mean that they are excluded from the purchase contract.

 

3. Delivery and shipping costs


SUMSUM the brand delivers worldwide. Depending on your address and the number of items in your order, shipping costs will be automatically displayed in your shopping cart. Please note that taxes and customs duties may apply and must be paid by the customer in the country of delivery. All orders are shipped within 2-4 business days. The average delivery time for domestic orders is an additional 1-2 business days. For all other orders, delivery may take up to 10 business days depending on the destination country. Please note that estimated delivery dates are not firm delivery dates. Additional delays may occur due to the CovidPandemic. Our shipping partners are Austrian Post and DHL. You can track your order at any time after it has been shipped with your tracking number. You also have the option to pick up your order in downtown Vienna. This option is only available by appointment.


4. Payment

PayPal and Klarna

During the ordering process, you will be redirected to the website of the online provider. In order to pay the invoice amount due, you must register there or create an account to confirm the payment with us. After submitting the order in the store, we request the payment provider to initiate the payment transaction. This transaction will be performed automatically after the goods have been shipped. You will receive further instructions during the ordering process.

PayPal services and other payment services

In cooperation with the payment service provider PayPal and Klarna, we also offer various other payment methods. For these services you do not need to be registered with the online provider to pay the invoice amount. Depending on the selected payment method, you will be redirected to the website of the selected payment service after submitting the order:

5. Right of withdrawal

You have the right to cancel the purchase contract within 14 days of receiving the goods by sending us a written request (email, postal mail). This can be done by you or a third party designated by you, who is not the deliverer, and without giving any reason.


Effects of cancellation

After we receive your item in unworn condition, we will refund your payment excluding shipping costs. This process can take up to 14 days. Please note that shipping costs for returns are the responsibility of the customer and must be sent to the following address:

6. Retention of title

The delivered goods remain the property of SUMSUM the brand until full payment has been received.


7. Transport damages

If you receive damaged goods, please contact us and the delivery service immediately. This will help us to make our own claims against the delivery service or transport insurance. Any failure to make such a claim will not limit any of your statutory rights and warranties.


8. Warranty and guarantees

The general warranty rights apply. Please read the care and use instructions carefully before ordering your product. We do not assume any liability in case of improper handling of our products.


9. Limitations of liability

The legal warranty regulations apply.



10. Information on dispute resolution

The European Commission provides a platform for online dispute resolution (OS). We are neither obliged nor willing to participate in a dispute resolution procedure.



11. Force majeure

If we are prevented from fulfilling the obligations of the contract due to force majeure or other circumstances beyond our control, we shall not be liable. In the event of any delays caused by such circumstances, we will perform our obligations as soon as reasonably possible.


12. Applicable law


All legal relations between the parties shall be governed by the laws of the Republic of Austria, excluding the laws on the international sale of movable goods. In the case of consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.
